Agreeing to these terms
These terms apply to this website, the free masterclass, The Selection Scanner and any other free resources we provide (together, "the Services"). They're an agreement between you and Barry Bainz LLC ("we", "us", "our"). By using the Services, you agree to these terms. If you don't agree, please don't use them.
Who can use the Services
You must be at least 18 and able to enter a binding agreement. If you register, the details you give us must be accurate and your own.
The free masterclass
The masterclass is free. We may change its date, time, length or content, or cancel it, and we'll do our best to let registered attendees know. If you can't make it live, a replay will be available for 72 hours afterwards. We record the full session, including the chat, so your name and anything you write in the chat may appear in the recording. Your registration is personal to you, so please don't share your joining link.
The Selection Scanner and other free tools
The Selection Scanner gives a general, automated estimate based on population and other public data. It's a starting point for your own research, not a guarantee that a business will succeed in any location or niche. It's provided as it is, and we don't promise it will always be available, accurate or up to date.
Education, not advice
Everything we share is for general educational purposes. It isn't legal, tax, financial or accounting advice, and it isn't tailored to your situation. Before you start a business, sign contracts with subcontractors or make financial decisions, check the rules where you live and speak to a qualified professional.
You're responsible for running any business you start, including getting the licences and insurance it needs, following the rules of any platform you use (such as Google), and treating your customers and subcontractors fairly.
No guarantee of results
The masterclass is educational and informational. It doesn't guarantee any business results, income or customers.
Any results we mention, including Barry's own and those of our students, are not typical and are not a promise of what you'll achieve. Joshua's story reflects his individual experience, and you shouldn't expect the same results. Many people who buy any business program see little or no results. Your results depend on your effort, skills, market, available time and many factors outside our control. Starting a business carries risk, including the risk of losing money.
Paid programs
After you register, you may be offered an optional VIP Ticket for $27. It includes The 90-Day Blueprint (a step-by-step roadmap), The Black Book (a video walkthrough of Barry's own digital storefronts), a group coaching call with Barry, and entry into a raffle for a one-to-one call with Barry. The full details are shown before you pay.
If you're not completely satisfied with your VIP Ticket, email barry@themiddlemanmafia.com within 7 days of purchase and we'll refund the full $27, no questions asked. After that, purchases are final, with two exceptions: if the group coaching call doesn't go ahead and isn't rescheduled, or the raffle for the one-to-one call isn't held, you can still ask for a full refund. This doesn't affect any refund rights you have by law.
If you choose to buy one of our paid coaching programs, it will be covered by its own agreement, which will set out what's included, the price, payment terms and any refund policy. If that agreement conflicts with these terms, that agreement wins for the paid program.
Using the Services fairly
Please don't misuse the Services. That includes trying to break or overload the site or our tools, scraping or copying them in bulk, using them for anything unlawful, or harassing anyone in the masterclass chat or our community spaces. We may remove anyone who does, without notice.
Our content
The site, the masterclass, our videos, tools, logo and other materials belong to us or the people who licensed them to us. You may use them for your own learning, but you may not copy, record, resell, republish or share them without our written permission.
Other websites and services
The Services rely on, and link to, third-party services such as WebinarJam, YouTube, Calendly, Typeform, WhatsApp, Discord and Zapier. Those services have their own terms and privacy policies, and we aren't responsible for them.
Messages from us
By registering, you agree to receive emails, text messages and calls about the masterclass and related offers as described in our Privacy Policy, including how to unsubscribe at any time.
Disclaimer
To the fullest extent the law allows, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent the law allows, we won't be liable for any indirect, incidental, special or consequential losses, or for lost profits, revenue or data, arising from your use of the free Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim, or $100. Nothing in these terms limits liability that can't legally be limited, including your statutory consumer rights.
Indemnity
If you break these terms or the law while using the Services, and that leads to a claim against us, you agree to cover the reasonable costs and losses that result, including legal fees.
Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Subject to any consumer rights that can't be waived, any dispute will be handled in the state or federal courts located in Miami-Dade County, Florida.
Your rights as a consumer
Nothing in these terms takes away any consumer rights you have under the law where you live, in the US, UK, Canada or elsewhere, that can't be changed by a contract. If any part of these terms conflicts with those rights, your rights win.
Changes to these terms
We may update these terms from time to time. When we do, we'll change the date at the top of this page. If you keep using the Services after a change, you accept the updated terms.
